1. Introduction
This Website Jumpstart Terms and Conditions Agreement (the “Agreement”) is entered into by and between Ryan Davis LLC, doing business as WebOps Hosting (“WebOps,” “we,” “us,” or “our”) and the customer (“Customer,” “you,” or “your”).
This Agreement is supplemental to our General Terms & Conditions, Acceptable Use Policy, and Privacy Policy, and to the terms of the hosting plan your website runs on. By ordering Website Jumpstart, you acknowledge that you have read, understood, and agree to be bound by these terms.
2. Definitions
- Template. One of the three website designs we make and maintain for Website Jumpstart: café or restaurant, shop, and services firm.
- Intake. The “Tell us about your business” form, and the files and answers you send us with it or after it.
- Start Date. The date we confirm to you in writing as the day work begins. We confirm it only when the Intake is complete, your hosting plan is active, and we have received your files.
- Delivery. The day we tell you in writing that your website is built and ready for your review.
- Revision Round. One consolidated list of changes you send us after Delivery, as described in section 5.
3. Scope of Service
Website Jumpstart is a fixed package. We build your website from one Template, filled in with the name, logo, photos, words, prices and contact details you send us, and set it up on your WebOps hosting plan.
The service includes:
- up to seven (7) pages, from the page set of the Template you choose;
- the forms that come with the Template, delivered to your own email address;
- one accent colour, chosen from a short set we provide;
- connecting your domain, setting up one business mailbox on it, and installing an SSL certificate;
- tidying the spelling and layout of the words you send us;
- one walkthrough of the website editor, of up to thirty (30) minutes, live or recorded, as you prefer;
- one Revision Round.
The shop Template is a catalogue: each item shows its photo, price and description, with buttons to enquire or to message you on WhatsApp. It has no cart, no checkout, and takes no payments.
Website Jumpstart does not include custom design work. Section 6 lists what is out of scope.
4. Eligibility and Hosting Term
To be eligible for Website Jumpstart, you must have an active WebOps Starter plan, or a higher plan, for the website.
Every Website Jumpstart order includes the first twelve (12) months of hosting on the Starter plan, billed annually at US$250, on the same first invoice as the setup fee.
5. Service Process
- You send us the Intake.
- We reply to confirm your Template and propose a Start Date. We place your order once you agree, and work begins on the Start Date once the invoice is paid.
- We deliver your website within five (5) business days of the Start Date for the café or restaurant and services firm Templates, and within seven (7) business days for the shop Template.
- You may send one Revision Round within seven (7) days of Delivery. A Revision Round covers up to ten (10) listed changes to text, images, or the order of sections. It does not add pages.
- Once the Revision Round is done, or the seven (7) days pass without one, we open the website to search engines and the service is complete.
If your content arrives after the Start Date, or we are waiting on you for an answer, the Start Date moves and we tell you the new date in writing. The delivery time does not run while we are waiting on you.
6. Limitations
The following are outside Website Jumpstart:
- custom design, a new layout, logo design, copywriting, and photography;
- more than seven (7) pages, a blog, or more than one language;
- online payments, checkout, booking calendars, memberships, and anything else that takes money;
- connections to third-party systems, such as point-of-sale, delivery apps, or accounting software;
- search engine campaigns, advertising, and email marketing.
If you ask for any of these, we tell you it is custom work, and section 14 applies.
7. Intellectual Property
Everything you send us, including your words, photos, logo and prices, remains your property.
The Templates, and the Foundry blocks and theme code they are built from, remain the property of WebOps. We grant you a non-exclusive, non-transferable licence to use them as part of your website, for as long as the website exists, including after it moves to another host.
You confirm that you own every image, text, logo and other material you send us, or that you have the right to use it on your website. You agree to indemnify WebOps against claims arising from material you supplied.
8. Customer Responsibilities
You agree to send complete and accurate content by the Start Date, to answer our questions promptly, and to review the website at Delivery.
After the service is complete, you are responsible for the content of your website and for the changes you make to it.
9. Disclaimer of Warranties
The Website Jumpstart service is provided on an “as-is” and “as-available” basis. WebOps makes no express or implied warranties regarding the service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
In no event shall WebOps be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to this service, including loss of data or loss of revenue. Our total aggregate liability shall be strictly capped at the total amount paid by the Customer for the specific Website Jumpstart service order.
11. Changes to Terms
We may change these terms. Changes are posted on this page with a new date. Changes do not alter an order already placed.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
13. Refunds
The 30-Day Money Back Guarantee covers your hosting.
The Website Jumpstart setup fee is refunded in full if you cancel before the Start Date. Once work has started on the Start Date, the setup fee is not refunded.
14. Referrals to Other Agencies
If you want work that is outside Website Jumpstart, we may introduce you to a web agency we trust. You contract with that agency directly. We do not guarantee, supervise, or take responsibility for its work, its prices, or its timelines, and we receive no fee for the introduction. Your website can stay on WebOps hosting afterwards.
15. Handover and Leaving
Your website is built to our Handoff Standard: an ordinary WordPress website that you, or any WordPress developer, can edit without us. If you leave WebOps, we migrate your website to your new host free of charge, under our Free Migrations terms.
