These Cloud VPS WordPress Hosting Terms & Conditions ("Agreement") are entered into by and between Ryan Davis, LLC, trading as WebOps Hosting ("WebOps Hosting", "we", "us", or "our"), and the customer ("you" or "your"). This Agreement governs your purchase and use of Cloud VPS WordPress Hosting services ("Services") provided by WebOps Hosting and is supplemental to the General Terms and Conditions, including the Acceptable Use Policy and the Privacy Policy. The ordering of Cloud VPS WordPress Hosting services from WebOps Hosting constitutes acceptance by the customer of the General Terms and Conditions and these Cloud VPS WordPress Hosting Terms and Conditions.
WebOps Hosting offers Cloud VPS WordPress Hosting services, which provide virtual private servers (VPS) optimized for WordPress hosting. The Services include dedicated resources, full root access, scalable performance, and customizable configurations to meet the needs of your WordPress websites.
Upon purchasing the Services, WebOps Hosting will provision your VPS with the agreed-upon resources and configurations. You are responsible for configuring and maintaining your WordPress installations, including software updates, security settings, and any additional software or services you choose to install on your VPS.
WebOps Hosting may offer initial setup assistance, including installation of WordPress and recommended configurations. Ongoing management of your VPS is your responsibility unless you have purchased a managed service plan.
The Services include specific allocations of CPU, RAM, storage, and bandwidth as detailed in your plan. You may scale these resources up or down as needed, subject to availability and any applicable fees. WebOps Hosting will monitor resource usage to ensure optimal performance but reserves the right to recommend or enforce upgrades if your usage exceeds the allocated resources or impacts the performance of other customers on the same infrastructure.
WebOps Hosting implements a range of security measures to protect the infrastructure and network, including firewalls, intrusion detection systems, and regular security audits. However, as the VPS owner, you are responsible for the security of your WordPress installations, including:
If you fail to maintain adequate security measures, WebOps Hosting reserves the right to suspend or terminate your account to protect the integrity of the infrastructure and other customers.
WebOps Hosting provides optional backup services for your VPS, which can be scheduled according to your preferences. Backups may include both full server images and individual WordPress site backups. You are responsible for ensuring that backups are configured correctly and that your data is protected. WebOps Hosting does not guarantee the integrity or availability of backups unless the backup service is purchased and properly configured.
You are encouraged to maintain your own backups in addition to any provided by WebOps Hosting.
WebOps Hosting strives to provide high availability for the Cloud VPS WordPress Hosting environment. The specific uptime guarantee and remedies for any service interruptions are outlined in the Service Level Agreement (SLA), which is incorporated into this Agreement by reference.
WebOps Hosting offers technical support to assist with issues related to the infrastructure and network. Support is available via email, ticketing system, or live chat, depending on your plan. Support for software and applications running on your VPS, including WordPress, is your responsibility unless you have purchased a managed service plan.
You will be billed by WebOps Hosting for the Services according to the plan you select during the signup process. Payment is due in advance, and failure to pay may result in suspension or termination of your VPS. WebOps Hosting reserves the right to adjust pricing with 30 days' notice.
Either party may terminate this Agreement at any time by providing 30 days' written notice to the other party. WebOps Hosting may also terminate this Agreement immediately if you breach any of the terms of this Agreement or fail to pay the applicable fees. Upon termination, WebOps Hosting will disable access to your VPS and may delete all associated data after a specified period.
To the maximum extent permitted by law, WebOps Hosting shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Cloud VPS WordPress Hosting Services, including but not limited to loss of business, revenue, profits, or data, even if advised of the possibility of such damages. Our total liability under this Agreement shall not exceed the amount paid by you for the Services in the 12 months preceding the event giving rise to the claim.
This Agreement shall be governed by and construed in accordance with the laws of the state of Delaware, without regard to its conflict of law principles. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of Delaware.
We reserve the right to modify these terms and conditions at any time. Any changes will be posted on our website, and your continued use of the Services constitutes acceptance of the modified terms.
