Free Migrations Terms & Conditions

1. Scope of Service

1.1 WebOps Hosting provides a free migration service for transferring WordPress websites to our hosting platform from another hosting provider (“Inbound Migration”).

1.2 WebOps Hosting also offers free migration services for transferring WordPress websites from our hosting platform to another hosting provider (“Outbound Migration”).

1.3 The free migration service is available exclusively for WordPress websites. Migrations involving other content management systems (CMS) or custom-built websites are not covered under this free migration service and may incur additional charges, subject to prior agreement.

2. Eligibility

2.1 To be eligible for the free migration service, the WordPress website(s) must be owned or operated by the Customer with an active hosting account with WebOps Hosting.

2.2 For Inbound Migrations, the customer must provide access to the source hosting account, including necessary credentials and any required authorization, to facilitate the migration process.

2.3 For Outbound Migrations, the customer must have an active hosting account with WebOps Hosting at the time of the request and provide necessary access details for the destination hosting provider.

3. Migration Process

3.1 Inbound Migration:

3.1.1 WebOps Hosting will assess the source hosting environment and provide an estimated timeline for the migration process.

3.1.2 WebOps Hosting will make reasonable efforts to migrate the WordPress website(s) to the WebOps Hosting platform with minimal downtime. However, WebOps Hosting does not guarantee uninterrupted service during the migration process.

3.1.3 The customer is responsible for reviewing the website(s) after the migration is complete and ensuring all content and functionality have been transferred correctly.

3.2 Outbound Migration:

3.2.1 The customer must request the Outbound Migration through the WebOps Hosting support system and provide access details for the destination hosting provider.

3.2.2 WebOps Hosting will make reasonable efforts to migrate the WordPress website(s) from the WebOps Hosting platform to the new hosting provider with minimal downtime. However, WebOps Hosting does not guarantee uninterrupted service during the migration process.

3.2.3 Upon completion of the migration, the customer is responsible for reviewing the website(s) on the new hosting platform and ensuring all content and functionality have been transferred correctly.

4. Limitations

4.1 The free migration service does not include reconfiguration of WordPress themes, plugins, databases, or other components that may be necessary to make the website fully functional on the destination platform. Such services may be provided at an additional cost.

4.2 WebOps Hosting is not responsible for any issues that arise from incompatible software, outdated plugins, or non-standard configurations during or after the migration process.

4.3 The free migration service is limited to WordPress websites that do not exceed 10GB in size. Websites exceeding this limit may incur additional charges, subject to prior agreement.

4.4 The customer is responsible for maintaining backups of their WordPress website(s) before the migration process begins. WebOps Hosting is not liable for any data loss that occurs during the migration.

5. Timing

5.1 WebOps Hosting will make reasonable efforts to complete migrations within the estimated timeline provided. However, the completion time may vary depending on factors such as the size of the website(s), the complexity of the source and destination environments, and the availability of required resources.

5.2 WebOps Hosting reserves the right to prioritize migration requests based on operational requirements and customer demand.

6. Customer Responsibilities

6.1 The customer must provide accurate and up-to-date information required for the migration, including but not limited to account credentials, access permissions, and technical details.

6.2 The customer must be available to assist with any issues that may arise during the migration process, including but not limited to providing additional information, authorizing changes, and testing the migrated website(s).

7. Disclaimer of Warranties

7.1 The free migration service is provided on an “as-is” and “as-available” basis. WebOps Hosting disclaims all warranties, express or implied, including but not limited to any warranties of merchantability, fitness for a particular purpose, and non-infringement, in relation to the migration service.

8. Limitation of Liability

8.1 WebOps Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, or loss of data, arising out of or related to the migration service.

8.2 WebOps Hosting’s total liability for any claim arising out of or related to the migration service shall not exceed the amount paid by the customer for the hosting services associated with the migration.

9. Changes to the Terms & Conditions

9.1 WebOps Hosting reserves the right to modify these Terms & Conditions at any time without prior notice. The customer’s continued use of the migration service following any such modification constitutes acceptance of the revised Terms & Conditions.

10. Governing Law

10.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
