Outlines the terms governing the use of our Managed WordPress Hosting services.

1. Introduction
This Managed WordPress Hosting Terms & Conditions Agreement ("Agreement") is between Ryan Davis LLC, dba WebOps ("WebOps", "we", "us", or "our") and the customer ("Customer", "you", or "your"). This document is supplemental to our General Terms & Conditions, Acceptable Use Policy (AUP), and Privacy Policy. By ordering our Managed WordPress Hosting services, you acknowledge your acceptance of this Agreement.
2. Service Description
Our Managed WordPress Hosting includes providing infrastructure, maintenance, core updates, security monitoring, and technical support specifically tailored for WordPress environments. We optimize servers to provide high performance, caching, and delivery capabilities uniquely suited for WordPress CMS software.
3. WordPress Maintenance
To ensure a secure and performant environment, WebOps assumes responsibility for specific routine maintenance tasks:
- Core Updates: Automated and managed updates for WordPress core software to the latest stable versions.
- Theme and Plugin Updates: Routine updates of themes and plugins to address security vulnerabilities and feature enhancements.
- Conflict Monitoring: Basic monitoring for conflicts that arise during standard updates, with immediate rollback procedures if site-breaking issues occur.
4. Administrative Access & Support User
Effective management requires WebOps to have continued, unrestricted administrative access to your WordPress installation.
Support User Account: A designated WordPress user account with the username support and the "Administrator" role is required for us to deliver the service. This account is essential for updates, troubleshooting, security audits, and performance tuning.
Maintenance of Privileges: You must maintain this account with full administrative privileges at all times. Modification, removal, or downgrading of the support account constitutes a material breach of this Agreement. If access is compromised or removed, you have twenty-four (24) hours to reverse the changes or provide a valid alternative, failing which the service may be suspended until access is restored.
5. Backup and Restore Services
WebOps performs automated daily backups of your WordPress files and database.
- Retention: Backups are retained for a period of thirty (30) days.
- Restoration: You may request a restoration from a backup via our support ticketing system.
- Customer Responsibility: While we maintain rigorous backup schedules, no system is infallible. Customers are strongly encouraged to maintain independent, off-site backups of their critical data.
6. Security Measures
We deploy robust security configurations including daily malware scans, web application firewalls (WAF), intrusion detection systems, and brute force protection mechanisms. Customers are required to implement strong passwords and maintain basic security hygiene across all administrative accounts connected to the WordPress site.
7. Service Availability
WebOps is committed to high availability as defined in our Service Level Agreement (SLA). Uptime guarantees apply to the server and infrastructure network, not necessarily to application-level errors caused by third-party plugins, custom themes, or developer code modifications.
8. Pageview Limits and Monitoring
Our Managed WordPress Hosting plans are tiered based on monthly pageview allowances. Pageviews are measured using the Independent Analytics platform.
- Measurement Tool: Independent Analytics Pro is included with your hosting plan and serves as the official measurement tool for determining pageview usage.
- Fair Usage: Pageview limits reset monthly. The service is intended for legitimate human traffic. Bot traffic (crawlers, indexing) is excluded from your total count. Unused pageviews do not roll over to the next month.
- Exceeding Limits: If your site exceeds the allotted pageviews for your plan, we will notify you and provide upgrade options. Additional pageviews are billed at $10.00 per 100,000 pageviews, or you may opt for a prorated plan upgrade. WebOps will never shut off your site without prior notice due to traffic spikes.
- CDN Integration: Plans include the QUIC.Cloud CDN with unmetered bandwidth and LiteSpeed caching to ensure optimal delivery and offload server resources regardless of traffic volume.
9. Support Services
Technical support covers WordPress core functionalities, theme and plugin configuration assistance, and general guidance. Support is provided via email, support tickets, and live chat. Support does not encompass custom development, design services, or extensive troubleshooting of poorly coded third-party plugins.
10. Customer Responsibilities
The Customer is responsible for:
- Providing accurate contact and billing information.
- Maintaining secure credentials and not sharing administrative access with unauthorized parties.
- Adhering to WordPress best practices regarding content and plugin usage.
- Reporting technical issues or security concerns promptly to our support team.
11. Limitation of Liability
WebOps shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the service. Our total aggregate liability is strictly capped at the amount of service fees paid by the Customer in the twelve (12) months preceding the claim.
12. Termination
Either party may terminate this Agreement with a thirty (30) days written notice. WebOps reserves the right to terminate services immediately and without notice in the event of a material breach (such as violation of our AUP) or non-payment. Upon termination, all customer data may be deleted from our servers.
13. Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
14. Amendments
WebOps reserves the right to modify this Agreement at any time. Significant changes will be communicated to Customers via email. Continued use of the service following such modifications constitutes acceptance of the updated terms.
