Domain Registrant Agreement

1. Introduction

These Domain Name Services Terms & Conditions ("Agreement") are entered into by and between Ryan Davis, LLC, trading as WebOps Hosting ("WebOps Hosting", "we", "us", or "our"), and the customer ("you" or "your"). This Agreement governs your purchase and use of domain name registration, transfer, and renewal services (collectively, the "Domain Services") provided by WebOps Hosting and is supplemental to the General Terms and Conditions, including the Acceptable Use Policy and the Privacy Policy. The ordering of Domain Services from WebOps Hosting constitutes acceptance by the customer of the General Terms and Conditions and this Domain Registrant agreement.

2. Domain Registration

By registering a domain name through WebOps Hosting, you agree to comply with the rules and policies of the applicable registry or registrar, including the Uniform Domain Name Dispute Resolution Policy (UDRP). You acknowledge that domain name registration is subject to availability and the applicable registry's rules, and WebOps Hosting does not guarantee the availability of any desired domain name.

3. Domain Transfer

You may transfer an existing domain name to WebOps Hosting by following the procedures outlined on our website. The transfer of domain names is subject to the policies of the existing and new registrars, and you agree to comply with these policies. Domain transfer fees may apply, and the domain's registration period may be extended by one year, depending on the registry's policies.

4. Domain Renewal

Domain names registered through WebOps Hosting will automatically renew at the end of the registration period, unless you disable automatic renewal or cancel the domain name in accordance with our cancellation policy. You are responsible for ensuring that your payment information is up to date and that sufficient funds are available for renewal. WebOps Hosting will make reasonable efforts to notify you before your domain name expires, but it is your responsibility to ensure that your domain is renewed on time.

5. WHOIS Data

As part of the domain registration process, you are required to provide accurate and up-to-date contact information for inclusion in the WHOIS database. You agree to promptly update your contact information as necessary. WebOps Hosting offers WHOIS privacy protection services to shield your personal information from public view; however, you remain responsible for ensuring that the information provided is accurate and compliant with applicable regulations.

6. Domain Name Disputes

You agree to comply with the Uniform Domain Name Dispute Resolution Policy (UDRP) and any other domain name dispute resolution policy adopted by the applicable registry. If a dispute arises concerning your domain name, you agree to submit to the jurisdiction of the courts and arbitration panels specified in the UDRP or other applicable policy.

7. Domain Cancellation, Suspension, and Deletion

WebOps Hosting reserves the right to cancel, suspend, or delete any domain name if:

  • You fail to pay the applicable fees.
  • You provide inaccurate or false WHOIS information.
  • You violate any of the terms of this Agreement, the UDRP, or the policies of the applicable registry.
  • A court or arbitration panel orders the cancellation, suspension, or deletion of the domain name.

Upon cancellation, suspension, or deletion of your domain name, WebOps Hosting may make the domain name available for registration by another party.

8. Limitation of Liability

To the maximum extent permitted by law, WebOps Hosting shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Domain Services, including but not limited to loss of domain name registration, transfer, or renewal, even if advised of the possibility of such damages. Our total liability under this Agreement shall not exceed the amount paid by you for the Domain Services in the 12 months preceding the event giving rise to the claim.

9. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the state of Delaware, without regard to its conflict of law principles. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of Delaware.

10. Amendments

We reserve the right to modify these terms and conditions at any time. Any changes will be posted on our website, and your continued use of the Domain Services constitutes acceptance of the modified terms.
