These Website Jumpstart Terms & Conditions ("Agreement") are entered into by and between Ryan Davis, LLC, trading as WebOps Hosting ("WebOps Hosting", "we", "us", or "our"), and the customer ("you" or "your"). This Agreement governs your use of Website Jumpstart services ("Services") provided by WebOps Hosting and is supplemental to the General Terms and Conditions, including the Acceptable Use Policy and the Privacy Policy. The ordering of Website Jumpstart services from WebOps Hosting constitutes acceptance by the customer of the General Terms and Conditions and these Website Jumpstart Terms and Conditions.
For the purpose of this Agreement, the following terms shall have the meanings defined below:
The Website Jumpstart service offered by WebOps Hosting is designed to accelerate the website development process by building from a theme demo, template kit, or design layout chosen by the customer.
The service includes the installation of the selected WordPress theme or template, the setup of core plugins, and the configuration of the website to match the chosen demo or layout as closely as possible.
This service is intended to provide a foundation for the customer to build upon. It does not include custom design work, content creation, or extensive modifications to the theme or template beyond the initial setup.
The Website Jumpstart service is available to all customers with an active Managed WordPress Hosting plan with WebOps Hosting.
After requesting the Website Jumpstart service, the customer will be asked to choose a WordPress theme, template kit, or design layout from the options available.
WebOps Hosting will install the selected theme or template on the customer's WordPress site, configure the necessary plugins, and set up the site to match the demo or layout as closely as possible.
The customer is responsible for providing any content (text, images, etc.) that they wish to have included during the setup process. If no content is provided, placeholder content will be used.
Once the setup is complete, WebOps Hosting will notify the customer, and the customer will be responsible for reviewing the site and making any additional customizations or content additions as desired.
The Website Jumpstart service does not include custom design work, creation of original content, or extensive modifications to the theme or template beyond the initial setup.
The service is limited to the installation and configuration of one theme or template. Additional changes or requests may incur additional charges, subject to prior agreement.
Examples of modifications that may be considered "extensive" and thus outside the scope of the basic service include, but are not limited to:
WebOps Hosting is not responsible for issues that arise from theme or plugin incompatibilities, third-party software, or custom code added to the website by the customer or other third parties.
Any content (including text, images, logos, and other media) provided by the customer for use in the Website Jumpstart service remains the property of the customer. WebOps Hosting does not claim any ownership over such content.
The designs, themes, templates, plugins, and any other components (collectively, "Items") used by WebOps Hosting to build and configure the website are licensed to WebOps Hosting. Upon final delivery of the website to the customer, WebOps Hosting sublicenses the rights to use these Items to the customer.
The sublicense granted to the customer is a Limited Sublicense, which permits the use of the Items only within the context of the website as configured and delivered by WebOps Hosting. The customer is not authorized to extract, reproduce, distribute, or otherwise use the Items outside of this context.
The customer acknowledges that the Limited Sublicense is granted solely for the purpose of using the website as a whole, and does not extend to the individual components of the design outside of their use within the website.
The customer must provide accurate and up-to-date information regarding their theme or template selection, as well as any content they wish to include during the setup process.
The customer must be available to review the completed setup and provide feedback or requests for any necessary adjustments within a reasonable time frame.
The customer is responsible for making any additional customizations or content additions to the website after the initial setup is complete.
The Website Jumpstart service is provided on an "as-is" and "as-available" basis. WebOps Hosting disclaims all warranties, express or implied, including but not limited to any warranties of merchantability, fitness for a particular purpose, and non-infringement, in relation to the service.
WebOps Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, or loss of data, arising out of or related to the Website Jumpstart service.
WebOps Hosting's total liability for any claim arising out of or related to the Website Jumpstart service shall not exceed the amount paid by the customer for the service.
WebOps Hosting reserves the right to modify these Terms & Conditions at any time without prior notice. The customer's continued use of the service following any such modification constitutes acceptance of the revised Terms & Conditions.
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
