These Terms of Service ("Terms") govern the use of the Managed Email Hosting services provided by Ryan Davis, LLC, trading as WebOps Hosting ("WebOps Hosting," "we," "us," or "our"). By using our email hosting services, you ("Customer," "you," or "your") agree to comply with these Terms. This agreement is designed primarily for business-to-business email services and is supplemental to the General Terms and Conditions, including the Acceptable Use Policy and the Privacy Policy. The ordering of Managed Email Hosting services from WebOps Hosting constitutes acceptance by the customer of the General Terms and Conditions and these Email Hosting Terms and Conditions.
WebOps Hosting provides traditional IMAP/POP3 mailboxes with robust security features, leveraging the Plesk control panel to manage outgoing email limitations and prevent unauthorized use. Our service includes monitoring and alerting systems, ensuring a high rate of email deliverability.
Email service is disabled by default on all Managed WordPress Hosting plans, restricting the domain to sending mail only via Sendmail. Customers who require full email services, including sending and receiving emails, can enable this by ordering the Managed Email Hosting Addon. This addon is available at no additional charge but does utilize some of the hosting account's storage.
We enforce a strict zero-tolerance spam policy. Any violation of this policy, including sending unsolicited bulk emails or spam, will result in the immediate disabling of your mail service.
Marketing emails, promotions, newsletters, and similar activities are strictly forbidden on our servers. Failure to comply with this prohibition will lead to immediate suspension of your email services. Our Acceptable Use Policy further outlines these restrictions.
Customers must comply with all applicable laws, including but not limited to the CAN-SPAM Act, data protection regulations, and other relevant legal requirements. Customers are responsible for understanding and adhering to best practices regarding email sender reputation and IP blacklisting.
Customers must maintain the security of their email accounts, including using strong passwords and monitoring account activity. In the event of any suspected breach or unauthorized use, customers must notify WebOps Hosting immediately.
WebOps Hosting employs Plesk control panel features to set limitations on outgoing emails, thereby preventing the use of our servers for spam or unauthorized activities.
Our servers utilize comprehensive postfix monitoring and alerting, ensuring that email deliverability remains near perfect globally.
WebOps Hosting reserves the right to suspend email services immediately if the customer violates these Terms, particularly the zero-tolerance spam policy or prohibited use clauses.
WebOps Hosting may terminate email services without notice in cases of severe or repeated violations of these Terms.
WebOps Hosting is not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, data, or business opportunities, resulting from the use of our email hosting services.
WebOps Hosting reserves the right to modify these Terms at any time. Customers will be notified of significant changes, and continued use of the services following such changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
