Introduction

Welcome to WebOps Hosting. By accessing our services, you agree to be bound by these General Terms and Conditions ("Terms"). If you do not agree to these Terms, you should not use our services.

Definitions

For the purposes of these Terms:

  • "WebOps Hosting Services" refers to the hosting, support, and any other services provided by WebOps Hosting.
  • "Customer" refers to any individual or entity using WebOps Hosting Services.

Payment Terms and Billing

3.1 Payment for services is due in advance of the service period. WebOps Hosting will charge the Customer's chosen payment method on a recurring basis until the Customer terminates the services.

3.2 All fees are non-refundable, except as provided in the Service Level Agreement (SLA) or under the 30-Day Money Back Guarantee.

Customer Responsibilities

4.1 The Customer is responsible for maintaining the security of their account credentials. This includes using strong passwords and regularly updating them.

4.2 The Customer must ensure that all software and applications hosted on WebOps Hosting Services are regularly updated and maintained.

4.3 The Customer agrees to comply with the Acceptable Use Policy and not to use WebOps Hosting Services for any illegal or unauthorized purposes.

4.4 The Customer is responsible for ensuring that their use of WebOps Hosting Services complies with all applicable laws and regulations.

Service Availability

5.1 WebOps Hosting aims to provide a reliable service with minimal downtime. Details on expected uptime and handling of outages are outlined in our Service Level Agreement (SLA).

5.2 In the event of a service outage, WebOps Hosting will work to restore services as quickly as possible. Customers may be entitled to compensation as outlined in the SLA.

Limitation of Liability

6.1 WebOps Hosting’s liability is limited to the amount the Customer has paid for services during the 12 months immediately preceding the event giving rise to the claim.

6.2 WebOps Hosting shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use our services.

6.3 These limitations apply to the fullest extent permitted by law and are not intended to waive any rights the Customer may have under Delaware law.

Privacy and Data Security

7.1 WebOps Hosting takes the privacy and security of Customer data seriously. Our practices are outlined in our Privacy Policy.

7.2 Customers are encouraged to implement additional security measures, such as encryption, to protect their data.

Termination

8.1 WebOps Hosting may terminate services if the Customer fails to comply with these Terms. In such cases, the Customer remains responsible for any outstanding fees.

8.2 The Customer may terminate services by providing notice through the Contact page. The termination will take effect at the end of the current billing cycle.

Dispute Resolution

9.1 Any disputes arising under these Terms shall be resolved through mediation or arbitration before being brought to court, in accordance with Delaware law.

9.2 The Customer agrees to bear their own costs in any dispute resolution proceedings.

Support

10.1 WebOps Hosting provides support as outlined in our Support Policy. Support is available between 9 AM and 5 PM, 7 days a week.

10.2 WebOps Hosting supports only WordPress websites and does not provide support for general website scripting and database issues.

Updates to Terms

11.1 WebOps Hosting reserves the right to update these Terms at any time. Significant changes will be communicated to the Customer via email or through a notice on our website.

11.2 Continued use of WebOps Hosting Services after any changes to these Terms constitutes acceptance of those changes.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles.
