Managed WordPress Hosting Terms & Conditions

1. Introduction

These Managed WordPress Hosting Terms & Conditions ("Agreement") are entered into by and between Ryan Davis, LLC, trading as WebOps Hosting ("WebOps Hosting", "we", "us", or "our"), and the customer ("you" or "your"). This Agreement governs your purchase and use of Managed WordPress Hosting services ("Services") provided by WebOps Hosting and is supplemental to the General Terms and Conditions, including the Acceptable Use Policy and the Privacy Policy. The ordering of Managed WordPress Hosting services from WebOps Hosting constitutes acceptance by the customer of the General Terms and Conditions and these Managed WordPress Hosting Terms and Conditions.

2. Service Description

WebOps Hosting offers Managed WordPress Hosting services, which include hosting, maintenance, updates, security, and support for WordPress websites. The Services provided are designed to optimize the performance, security, and functionality of your WordPress site.

3. WordPress Maintenance

As part of the Services, WebOps Hosting will perform regular maintenance on your WordPress website, including:

  • Core WordPress updates to ensure your site is running the latest stable version.
  • Theme and plugin updates to maintain compatibility and security.
  • Monitoring for any conflicts or issues arising from updates, with prompt resolution where possible.

4. Administrative Access and Support User

As part of our Managed WordPress Hosting service, we create and maintain an administrative user account with the username 'support'. This account is essential for:

  • Performing critical software updates and maintenance
  • Providing technical support and troubleshooting
  • Monitoring and addressing security concerns
  • Managing website performance optimization

The integrity of this support account is crucial for service delivery. Therefore:

  1. The 'support' user must maintain full administrator privileges
  2. Any modification, removal, or role downgrade of the 'support' user constitutes a material breach of these terms
  3. If such modifications are not reversed within 24 hours of notification, we reserve the right to:
    • Suspend the Managed WordPress Hosting service immediately
    • Restore necessary administrative access
    • Take appropriate measures to ensure service continuity

Customers retain full responsibility for their own administrative accounts while acknowledging the necessity of the 'support' user for service delivery.

5. Backup and Restore Services

WebOps Hosting will provide regular backups of your WordPress site, including both the database and files. Backups are performed on a daily basis and stored for a retention period of 30 days. You can request a site restoration from a backup at any time within the retention period.

While WebOps Hosting takes reasonable efforts to ensure backups are performed and stored correctly, you are encouraged to maintain your own backups as an additional precaution.

6. Security Measures

WebOps Hosting implements a range of security measures to protect your WordPress site, including:

  • Regular security scans to detect and remove malware or vulnerabilities.
  • Firewall protection and intrusion detection systems.
  • Brute force protection and login security enhancements.

While WebOps Hosting takes proactive steps to secure your site, you are responsible for following best practices, such as using strong passwords and keeping your account information secure.

7. Service Availability

WebOps Hosting strives to provide high availability for your WordPress site. The specific uptime guarantee and remedies for any service interruptions are outlined in the Service Level Agreement (SLA), which is incorporated into this Agreement by reference.

8. Support Services

WebOps Hosting offers support services as part of the Managed WordPress Hosting plan. Support is available for:

  • WordPress core functionality issues.
  • Theme and plugin-related questions and troubleshooting.
  • General WordPress guidance and best practices.

Support is provided via email, ticketing system, or live chat, depending on the plan selected. WebOps Hosting does not offer custom development or design services as part of the standard support plan.

9. Customer Responsibilities

You agree to:

  • Provide accurate and complete information during the registration process and maintain the accuracy of this information.
  • Keep your account credentials secure and confidential.
  • Follow best practices for WordPress site management, including the use of strong passwords and limiting access to authorized users.
  • Promptly inform WebOps Hosting of any issues or changes that may affect the Services.

10. Limitation of Liability

To the maximum extent permitted by law, WebOps Hosting shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Managed WordPress Hosting Services, including but not limited to loss of data, website downtime, or security breaches, even if advised of the possibility of such damages. Our total liability under this Agreement shall not exceed the amount paid by you for the Services in the 12 months preceding the event giving rise to the claim.

11. Termination

Either party may terminate this Agreement at any time by providing 30 days' written notice to the other party. WebOps Hosting may also terminate this Agreement immediately if you breach any of the terms of this Agreement or fail to pay the applicable fees. Upon termination, WebOps Hosting will disable access to your WordPress site and may delete your data after a specified period.

12. Governing Law & Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the state of Delaware, without regard to its conflict of law principles. Any disputes arising out of or in connection with this Agreement shall be resolved in the courts of Delaware.

13. Amendments

We reserve the right to modify these terms and conditions at any time. Any changes will be posted on our website, and your continued use of the Services constitutes acceptance of the modified terms.
